1. Introduction
Welcome to BitInPeace! By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and BitInPeace, a company registered in the Netherlands and providing services globally. If you do not agree to these Terms, please refrain from using our services.
2. Acceptance of Terms
By using our services, you confirm that you have read, understood, and agree to these Terms. Your continued use of the platform signifies your acceptance of any changes to these Terms.
3. Updates to Terms
BitInPeace reserves the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting on our website. We will notify you of material changes by providing a notice through the platform or via email if you have provided one. It is your responsibility to review these Terms periodically. Your continued use of the platform after any changes constitutes acceptance of the new Terms.
4. Platform Overview
BitInPeace is a platform designed to securely manage digital assets (Bitcoin and Ethereum) by enabling users to protect, transfer, and manage their crypto holdings through wallet-connected services. Users retain full control of their private keys, and our platform operates on a trustless model to ensure user autonomy and security.
5. Eligibility
By using BitInPeace, you confirm that:
- You are at least 18 years old or the legal age of majority in your jurisdiction.
- You have the legal authority to agree to these Terms and to use the platform in compliance with all applicable laws and regulations.
- You are not prohibited from using the platform under any applicable laws or regulations.
- You are not a person with whom transactions are prohibited under economic or trade sanctions, anti-terrorism laws, or other applicable laws.
6. Device Security and Unauthorized Access
Our platform does not require a traditional account registration process; instead, you access our services directly by connecting through your wallet. It is your responsibility to ensure the security of your device and wallet to prevent unauthorized access. BitInPeace is not liable for any unauthorized access to your wallet or device.
7. User Responsibilities
As a user of BitInPeace:
- Compliance with Laws: You agree to use the platform in compliance with all applicable laws and regulations, including anti-money laundering (AML), counter-terrorist financing (CTF), and sanctions laws.
- Prohibited Use: You must not use the platform for any illegal or unauthorized purpose, including activities related to money laundering, terrorist financing, fraud, or other criminal activities.
- Private Keys: You are solely responsible for managing and securing your private keys, wallet credentials, and other authentication mechanisms. BitInPeace will never request access to your private keys and cannot retrieve or reset lost keys.
- Asset Security: BitInPeace is not responsible for any loss of access to your digital assets due to lost private keys or any other security breaches outside our platform’s control.
- Accurate Information: You agree to provide accurate and complete information during the use of the platform where applicable.
8. User Conduct and Restrictions
You agree not to engage in activities that:
- Violate any applicable laws or regulations.
- Infringe on any third-party rights, including intellectual property rights.
- Introduce viruses, malware, or other harmful code to the platform.
- Attempt to gain unauthorized access to our systems or other users' wallets.
- Disrupt or interfere with the security or integrity of the platform.
9. Wallet Connection and User Privacy
We are committed to protecting your privacy and minimizing the collection of personal information. While using BitInPeace, you can connect your wallet securely while preserving anonymity regarding wallet activities.
We do not collect or store personal identity information such as first name, last name, date of birth, or country of residence. However, Stripe, our payment processor, may request this information during payment processing to comply with financial regulations. BitInPeace does not process or store this data.
The only personal information BitInPeace stores is your email address, which is used solely for essential service activities like service updates and reminders. All data is encrypted and protected against unauthorized access.
10. Fees, Payments, and Subscription Terms
BitInPeace operates on a subscription-based pricing model with an optional 30-day free trial for new users. By subscribing, you agree to the following terms:
- Trial Period: New customers may be eligible for a one-time 30-day free trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid annual plan, and the applicable fee will be charged. Trial availability is subject to change.
- Recurring Payments: Subscriptions are billed annually via Stripe’s Hosted Checkout Page, and the applicable fee is charged automatically renewed at the start of each billing cycle.
- Payment Processing: All transactions, including payment verification, tax calculation, and fraud prevention, are handled securely by Stripe. BitInPeace does not collect, store, or process any payment information such as credit card numbers or bank details.
- Renewal Reminder: A subscription renewal email will be sent 7 days before renewal, allowing users to manage or cancel their subscription before the next billing cycle.
- Subscription Management: You can manage, cancel, or update your subscription via Stripe’s customer portal. After successful authentication to the BitInPeace platform, a direct access link to Stripe's customer portal is provided under the Settings page.
- Changes in Pricing: We reserve the right to adjust our pricing at any time. Any changes will be communicated in advance, and you will have the option to cancel before the new rates take effect.

11. Refund and Cancellation Policy
BitInPeace does not offer refunds for partially used subscription periods. However, you may cancel your subscription at any time, and your service will remain active until the end of the current billing cycle.
- Trial Cancellation: If you cancel during the 30-day trial period, you will not be charged.
- No Partial Refunds: Once a subscription is billed, no refunds will be issued for the remaining period.
12. Asset Transfer and Inactivity Conditions
BitInPeace allows users to set customizable asset transfer conditions, such as transferring assets to successors or secondary wallets after a period of inactivity:
- Inactivity Period: Users are responsible for setting their desired inactivity period, up to a maximum of 12 months. Once this period is reached, the platform will automatically initiate the asset transfer as specified by the user.
- Asset Recipients: You are solely responsible for specifying accurate wallet addresses or recipients. BitInPeace is not responsible for transfers made to incorrect wallet addresses due to user input errors.
- Transfer Process: The platform uses the quickest and most cost-effective transfer methods available at the time the order is placed. Users acknowledge that delays may occur due to the blockchain's decentralized nature, and BitInPeace is not responsible for such delays.
13. Intellectual Property Rights
All intellectual property related to the BitInPeace platform, including but not limited to logos, designs, content, and technology, is the sole property of BitInPeace. You are granted a limited, non-exclusive, and revocable license to use the platform in accordance with these Terms. You may not modify, distribute, or reproduce any part of the platform without prior written consent from BitInPeace. You must not misuse BitInPeace’s intellectual property, including implying a relationship with or endorsement by BitInPeace without permission.
14. Disclaimers
No Financial Advice: BitInPeace does not provide financial, legal, or investment advice. Any information provided is for informational purposes only, and you should consult a qualified professional for advice.
As-Is Basis: The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the platform will be available at all times or error-free.
15. Limitation of Liability
To the fullest extent permitted by law, BitInPeace, its affiliates, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, including but not limited to:
- Loss of access to your digital assets.
- Unauthorized access or security breaches beyond BitInPeace’s control.
- Incorrect transactions resulting from user input errors.
In no event shall BitInPeace’s total liability exceed the fees paid by you in the twelve months preceding the event giving rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless BitInPeace, its affiliates, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the platform, violation of these Terms, or infringement of any rights of a third party.
17. Force Majeure
BitInPeace shall not be liable for any delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, governmental actions, war, terrorism, civil unrest, technical failures, or any other force majeure event.
18. Sanctions, Prohibited Countries, and Restricted Individuals
18.1 Compliance with Laws and Sanctions
BitInPeace does not manually verify users for compliance with international sanctions. Instead, we rely on Stripe’s automated verification to ensure compliance with:
- The European Union (EU)
- The United States Office of Foreign Assets Control (OFAC)
- The United Nations (UN)
- Other applicable financial regulators
If Stripe blocks a transaction due to sanctions compliance, BitInPeace will not override this decision and will not activate the subscription.
18.2 Prohibited Countries and Regions
BitInPeace does not control which transactions Stripe approves or declines but follows Stripe’s compliance policies. Stripe may block transactions from users located in, or associated with, countries under comprehensive sanctions, including but not limited to:
- North Korea
- Iran
- Syria
- Crimea, Donetsk, and Luhansk regions of Ukraine
- Any other countries or regions subject to comprehensive embargoes or sanctions
Users attempting to access BitInPeace from these regions will not be able to complete a subscription purchase.
18.3 Restricted Individuals and Entities
You represent and warrant that you are not:
- Listed on any government-issued sanctions list, such as the U.S. Specially Designated Nationals (SDN) List or the EU’s Consolidated List of Financial Sanctions Targets.
- Affiliated with any organization engaged in activities that violate international sanctions.
If Stripe detects that a user is in violation of these policies, BitInPeace reserves the right to terminate access immediately, and no refund will be issued.
18.4 Prohibited Use
You agree not to use the platform for any transactions or activities that:
- Involve individuals, entities, or countries that are subject to sanctions.
- Support, finance, or engage in illegal activities, including terrorism or the proliferation of weapons of mass destruction.
18.5 Monitoring and Enforcement
BitInPeace reserves the right to:
- Monitor transactions and user activity to ensure compliance with applicable laws and regulations.
- Block transactions or asset transfers that involve prohibited individuals, entities, or countries.
- Suspend or terminate access to the platform for users who violate these provisions.
- Report any suspicious activity or potential sanctions violations to relevant authorities.
19. Termination and Suspension of Services
BitInPeace may suspend or terminate your access to the platform at any time and for any reason, including for breach of these Terms, unauthorized use of the platform, or legal requirements. Upon termination, your access to the platform will cease, and any transfer requests or settings in place may be voided at BitInPeace’s discretion.
20. Discontinuation of Services and Bankruptcy Policy
20.1 Continuation of Service in the Event of Bankruptcy or Business Discontinuation
In the event of bankruptcy, insolvency, or a decision by BitInPeace to cease operations, we will continue to provide essential services to process existing pre-signed transactions for the maximum user-defined inactivity period, capped at 12 months. Specifically:
- Transaction Fulfillment: We will continue to monitor inactivity periods and ensure that pre-signed transactions are broadcasted according to the conditions set by users, even during the winding down of operations.
- No New Customers: During this period, we will not accept new customers, maintaining our focus on fulfilling obligations to existing users.
- No Extension of Inactivity Duration: After the bankruptcy or business discontinuation is announced, the inactivity duration set by users will not be extended beyond the initially configured period.
20.2 Refunds for Unused Services
This section applies only if BitInPeace ceases operations. BitInPeace does not offer refunds for partially used subscription periods. However, you may cancel your subscription at any time, and your service will remain active until the end of the current billing cycle.
In the event of BitInPeace ceasing operations, all active subscriptions will continue until their expiration date. However, no refunds will be issued for any remaining subscription time.
20.3 Communication and Support During Wind-Down
BitInPeace will provide timely communication to all users if we foresee the need to wind down operations. This communication will include:
- Details about the timeline for continuing service during the inactivity period.
- Clear guidance on the process for requesting and receiving refunds.
- Ongoing support for managing pre-signed transactions, ensuring users are fully informed throughout the wind-down process.
We are committed to minimizing any disruption and ensuring that your assets are managed as per the settings you have configured, even in the case of business discontinuation.
21. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands. You agree to submit to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, to resolve any dispute arising out of or in connection with these Terms or the platform.
For consumers located outside the Netherlands, mandatory consumer protection laws in your country may apply and provide additional rights.
22. Dispute Resolution
In the event of any dispute arising from your use of BitInPeace, we encourage you to first contact us via email to seek a resolution. If a resolution cannot be reached, disputes shall be resolved by the competent courts in Amsterdam, the Netherlands, unless mandatory legal provisions dictate otherwise.
23. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
24. Entire Agreement
These Terms constitute the entire agreement between you and BitInPeace regarding your use of the platform and supersede all prior agreements and understandings.
25. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without prior written consent from BitInPeace. We may assign or transfer our rights and obligations under these Terms without restriction.
26. Notices
All notices or other communications required or permitted under these Terms shall be in writing and given by BitInPeace via email (if you have provided one), or by posting on our website.
